Terms and Conditions

1. Scope of Application, Contract Partners

These terms and conditions, hereinafter referred to as "AGB," apply to all consumers and business customers, hereinafter referred to as "buyers." The AGB apply to every purchase agreement made via the online store of Studio Moreandless, as well as purchase agreements made by phone or orally.

All contracts are concluded with Studio Moreandless. For further information, please refer to the imprint. You can reach our customer service for questions, complaints, and orders by phone and email using the contact details provided on the website under the "Contact" section.


2. Conclusion of Contract

The display of products in the online store does not constitute a legally binding offer. By clicking the "Order" button, you submit a binding order for the products in the shopping cart. The confirmation of receipt of the order is sent immediately after submission by an automated email, which also serves as acceptance of the order. The purchase contract is concluded upon receipt of this email confirmation. A valid contract is only formed when the order process is completed by submitting the order.

(2) The ordered products may differ slightly in color from their online depiction due to technical limitations, as long as this is reasonable. Wood is a natural product and may have inherent imperfections. These are not grounds for a complaint.

(3) The contract is subject to the condition of proper self-supply, i.e., if the seller is unable to deliver the goods or can only deliver partially. This applies only if the non-delivery is not due to the seller’s fault, and the seller has made reasonable efforts to procure the goods from the supplier. The seller will take all reasonable steps to source the goods. Otherwise, the payment will be refunded immediately. In case of non-availability or partial availability of goods, the buyer will be informed immediately.

(4) The contract content will be stored by the seller and sent to the customer along with the AGB via email.


3. Retention of Title

(1) For consumers, the seller retains ownership of the goods until the full payment of the purchase price is made.

(2) If the customer behaves contrary to the contract, particularly in cases of delayed payment, false information about creditworthiness or identity, or if an application for insolvency proceedings is filed, the seller is entitled to withdraw from the contract and demand the return of the goods, provided the customer has not yet fully made the payment.


4. Remuneration

(1) The stated purchase price is binding. The purchase price includes VAT. Additional shipping costs can be found in the order summary. Packaging costs are already included in the shipping costs.

(2) The seller reserves the right to release the ordered goods for delivery only after the confirmed receipt of payment via advance payment or deposit.

(3) The customer may only offset amounts with undisputed or legally established claims, or in the case of a legal dispute, with disputed but decision-ready counterclaims arising from product liability in the contractual relationship.

(4) The assertion of retention rights or the raising of the defense of non-fulfillment of the contract due to counterclaims is only possible if the counterclaim, upon dispute by the seller, is legally established or, in case of a legal dispute, decision-ready. For undisputed counterclaims by the seller, the assertion of retention rights or the defense of non-fulfillment is always possible.


5. Payment Methods

(1) The customer can pay by advance payment/bank transfer, credit card, or PayPal (direct debit and credit card payment). The seller reserves the right to make payment by invoice subject to a credit check of the buyer.

(2) When paying via PayPal (direct debit and credit card payment), the customer must sign up at www.paypal.com. The terms and conditions of the providers apply.

(3) The seller reserves the right to adjust, expand, or reduce the available payment methods at their discretion.


6. Shipping

(1) The service is provided in Berlin. If the service location deviates, the seller will inform the buyer promptly. The seller delivers within the EU and Switzerland. For orders outside these countries, the buyer must contact the seller. Additional costs may apply. Self-collection by the buyer is only possible by prior arrangement, and shipping costs are typically waived in this case.

(2) The delivery period is specified on the respective offer page. The delivery period begins one day after the full receipt of payment.

(4) If the start or end of the period falls on a Saturday, Sunday, or a public holiday in NRW or Berlin, the period start or end will be postponed to the next working day.

(5) If the period start or end falls within the company holidays specified on the website, the period start or end will be moved to the first working day after the holidays. All company holidays are announced in advance on the website.

(6) Regarding the reservation of proper self-supply, the seller refers to § 2 para. 3 of these AGB.

(7) The seller is entitled to partial deliveries if there is a legitimate reason and the partial delivery is reasonable for the buyer. No additional costs will be charged to the buyer for partial deliveries.


7. Right of Withdrawal

(1) Right of Withdrawal

The withdrawal period is fourteen days from the day you or a third party designated by you (not the carrier) have taken possession of the last good or the last part of the order. Whether a product is pre-produced or custom-made can be found in the product description.

Custom-made products are generally excluded from exchange unless they have an unacceptable defect.

By a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. If you use this option, we will send you a confirmation of receipt of your withdrawal within 1-5 working days by email.

To meet the withdrawal deadline, it is sufficient for you to send the notice before the withdrawal period expires.

(2) Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, excluding delivery costs, without undue delay and within 30 days from the day we receive your notification of withdrawal. We will use the same payment method you used in the original transaction unless otherwise agreed with you. In no case will you incur any fees for this refund.

We may refuse to refund until we have received the goods back.

You must return the goods without delay, and in any case, no later than three days from the day you notify us of the withdrawal. The deadline is met if you send the goods before the three-day period expires.

You must bear the direct costs of returning the goods. You are only liable for any diminished value if this is due to handling the goods in a way that was not necessary to check their condition, properties, and functionality.


8. Transfer of Risk

(1) The risk of accidental loss or deterioration of the sold goods passes to the buyer upon delivery of the goods.

(2) If the buyer has appointed the carrier, freight forwarder, or any other third party for the delivery and the seller has not specified this party, the risk passes to the buyer once the goods are handed over to the carrier.

(3) The handover is considered complete if the buyer is in default of acceptance.


9. Rights of the Buyer

(1) Information, drawings, illustrations, technical data, weight, measurements, and performance descriptions outside our webshop are for informational purposes only. Studio Moreandless does not guarantee the accuracy of these details. The content of the order confirmation will be decisive for the type and scope of the delivery.

(2) If a warranty-related defect is present, the buyer has the legal rights specified by law. A warranty-related defect occurs if the original function of the product is not guaranteed, or if the appearance is significantly impaired due to processing or delivery errors.

(3) In the case of returns due to defects, the seller will bear the return costs. The seller reserves the right to replace the return by personally collecting the goods.

(4) The seller is not liable for constant and uninterrupted availability of the online offer.


10. Limitation of Liability

(1) The seller is only liable for its own content on its website. The seller is not responsible for external content linked to other websites.

(2) The seller is not liable for slight negligence regarding non-essential contractual obligations.

(3) Further, the statutory provisions apply.


11. Consumer Dispute Resolution

We are willing to participate in a dispute resolution process before a consumer arbitration board. The competent consumer arbitration board is:

12. Final Provisions

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
